Tin Can Customs Explains Enforcement Actions Taken on MT NY Maria

The Nigeria Customs Service (NCS), Tin Can Island Port Command, wishes to correct misleading reports regarding enforcement measures taken against the vessel MT NY Maria, which was found di Terminal (Dantata Jetty), Tin Can Island Port.

According to a press statement signed by CSC Oscar Ivara, On 23 May 2026, officers of the Boarding and Rummaging Unit boarded the vessel upon arrival from the Dangote Refinery to conduct routine compliance checks under the Nigeria Customs Service Act, 2023 (Act No. 35). It was discovered that the vessel lacked mandatory documentation, particularly the Last Port Clearance. In line with procedure, the vessel was sealed and placed under Customs control, while its agent was given two days to produce the outstanding document.

However, on 27 May 2026, intelligence revealed that the vessel had commenced discharge operations despite being under Customs seal and without clearance. Officers mobilised to the terminal, overcame resistance from facility security, and lawfully halted the unauthorised discharge. The ship master was invited to provide statements to the Enforcement Unit; contrary to speculation, no arrest was made. The vessel was resealed in accordance with procedure.

The actions taken were fully supported by the Nigeria Customs Service Act, 2023. Sections 30–35 empower Customs to control, inspect, and verify goods within Customs Control Zones, while Sections 46–58 outline obligations for reporting, declaration, unloading, and clearance. Furthermore, Sections 212, 222, 223, 225, and 226 authorise officers to board, inspect, detain, and enforce compliance on vessels operating within Customs areas. Violations of this nature attract sanctions under Part XXXI of the Act, including seizure, forfeiture, and penalties.

Investigations into the incident, including obstruction faced by officers, are ongoing. The Service reiterates that no vessel, terminal operator, or individual is above the law. All stakeholders must comply fully with documentation and clearance requirements before commencing discharge or cargo-handling operations.
